Madras High Court Upholds Dismissal of TNSTC Conductor for Threatening Manager, Citing Past Misconduct

The Madras High Court upheld the dismissal of a Tamil Nadu State Transport Corporation conductor for threatening his Branch Manager, noting that the punishment was not disproportionate due to the employee’s prior misconduct.

A Division Bench of Justices C. V. Karthikeyan and R. Vijayakumar observed that the conductor had previously been disciplined on four occasions for similar misbehaviour.

The Court held that past records must be considered when assessing the proportionality of punishment and found no illegality in the dismissal order. The appeal challenging the termination was dismissed.
