
The Madras High Court has held that minor, technical or rectifiable breaches of Indian regulatory laws do not violate the fundamental policy of India and cannot prevent the enforcement of a foreign arbitral award.
Justice Abdul Quddhose noted that enforcement courts cannot reassess arbitrators’ interpretation of contracts or evidence.
Claims of illegal share buybacks, fraud, or violations of public policy were rejected, emphasising India’s commitment to honouring foreign arbitral awards under international treaties.
