The Madurai Bench of the Madras High Court reiterated that while the right to protest is fundamental, it must not interfere with the public’s rights to peace and free movement.
Justice B. Pugalendhi held that protests should not cause inconvenience, persistent irritation or visual and auditory aggression to bystanders.
The Court was hearing Naam Tamilar Katchi (NTK) plea after police denied protest permission citing a temple festival, weekly market, and prior agitation on the same issue. The court also noted the use of provocative language in earlier protests.
The court allowed NTK to file a fresh application and directed police to decide within 24 hours. Subsequently, police granted permission.
