The Madras High Court has held that while deciding visitation rights, courts must prioritise the child’s schooling and physical, moral, and emotional development.
The case involved a mother seeking divorce, during which the father applied for visitation rights to meet their minor daughter.
The trial court allowed his plea, but the mother challenged the order, citing his failure to pay maintenance and the difficulty of travelling with the child.
Considering the child’s best interests, the High Court modified the visitation arrangement and directed that visits take place at a more convenient location.
