Child Maintenance is a Right, Not Charity Both Parents Share Equal Responsibility : Delhi High Court

The Delhi High Court has ruled that child maintenance is not a favour but a legal obligation, recognising shared parental responsibility.

The court dismissed a husband's plea against paying ₹50,000 per month for two minor children, noting attempts to conceal income and rejecting claims of inflated demand.

The Court emphasized that the custodial parent, regardless of gender, performs essential caregiving duties deserving respect and financial support.

The court also clarified that maintenance orders do not undermine the role of non-custodial parents, as both parents must balance work and parenting responsibilities. The plea was dismissed as baseless.
