The Court emphasised that mediation’s objective is to find a humane, sustainable solution tailored to the couple's unique situation, whether that involves staying together or parting ways respectfully.
The court also observed that pre-institution mediation is mandatory in commercial disputes under the Commercial Courts Act.
The bench directed the case at hand to be referred to mediation, underscoring that separation can be a respectful and consensual outcome.
