The HC set aside the 20-year prison sentence imposed by a lower court on a man accused of sexually assaulting a 10-year-old girl based on the victim’s statement recorded under Section 164 of CrPc and the medical report.
The Court held that the victim’s statement and medical report are not substantive evidence, but can only be used for corroboration.
Citing the State of Karnataka vs. P. Ravikumar case, the court ruled that the victim's testimony should be considered with other evidence, and a conviction cannot be based solely on medical findings.
