Mere FIR Registration Need Not be Disclosed in Election Nomination: Delhi High Court

The Court held that mere registration of an FIR does not amount to pendency of a criminal case requiring disclosure under Section 33A of the Representation of the People Act.

It observed that the obligation to disclose arises only when charges are framed or cognizance of the offence is taken by a court. 

The Court further observed that the object of disclosure is to provide voters limited statutory information in accordance with law. It noted the absence of pleadings showing knowledge or deliberate concealment by the candidate.

The Court dismissed the election petition challenging Manish Sisodia’s 2020 election.
