Meta Appeals ₹213.14 Crore Penalty for Abuse of Dominant Position

  • Case Name: Meta Platforms Inc. vs. Competition Commission of India (CCI)
  • Judge(s): Justice (retd) Ashok Bhushan (NCLAT)
  • Advocate(s): Senior Advocates Kapil Sibal and Mukul Rohatgi

Meta Platforms Inc. appealed to the National Company Law Appellate Tribunal (NCLAT) against a ₹213.14 crore penalty imposed by the Competition Commission of India (CCI).

The CCI found that WhatsApp's 2021 privacy policy, which mandated user data sharing with Meta, abused Meta's dominant position. The CCI ordered WhatsApp to stop making data-sharing a pre-condition for using the service and to provide clear explanations on data use.

Senior Advocates Kapil Sibal and Mukul Rohatgi requested an urgent hearing, which was scheduled for January 16, 2025, by NCLAT's Justice (retd) Ashok Bhushan.
