Meta Platforms has appealed to the National Company Law Appellate Tribunal (NCLAT) against the Competition Commission of India’s (CCI) ₹213.14 crore penalty imposed in November for unfair business practices related to WhatsApp’s 2021 privacy policy update.
The social media giant cited seven key reasons, arguing that the CCI's investigation was an abuse of power, as the issue was already sub-judice before the Supreme Court.
Meta contended that the CCI failed to establish any prima facie evidence of antitrust violation and that the order was passed without jurisdiction.
The company also claimed the policy update was transparent and pro-competitive.
