Minor Discrepancies in Victim's Testimony Shouldn't Weaken Genuine Sexual Exploitation Cases

  • Case Name: Satish Kumar v. State
  • Judge(s): Justice Manoj Kumar Ohri

The Delhi High Court upheld the conviction of an accused under Sections 451, 376, and 506 of the IPC, emphasizing that minor inconsistencies in a victim's testimony should not weaken a credible prosecution case.

Justice Manoj Kumar Ohri observed that the victim’s testimony, if credible, is sufficient for conviction without corroboration.

The accused’s sentence was modified to time already served, considering mitigating factors, including the victim’s affidavit pardoning the accused and satisfactory jail conduct.

The Trial Court had sentenced the accused for rape, criminal intimidation, and trespass, which the High Court deemed justified but adjusted in light of circumstances.
