
The Delhi High Court held that making a minor touch an adult’s private part with sexual intent constitutes aggravated sexual assault under Section 10 of the POCSO Act.
The case arose from an appeal against conviction, where a tenant allegedly exposed himself and caused a child under 4 to touch him.
The Court found that the child’s ability to testify was verified through preliminary questions and accepted the explanation for the FIR delay.
It upheld the 7-year sentence under POCSO, but set aside IPC convictions under Sections 354, 354A and 354B.
