Mocking Husband’s Disability is Mental Cruelty: Orissa HC Grants Divorce

The Orissa High Court has upheld a divorce under Section 13(1)(i-a) of the Hindu Marriage Act, recognizing mental cruelty after a wife repeatedly mocked her husband's physical disability, using terms like ‘Nikhatu’ and ‘Kempa’.

The husband, physically handicapped, faced constant derogatory remarks, causing deep emotional pain. Despite cross-examination, the wife failed to disprove the claims.

The Court emphasized that respect and support are essential in marriage.

While divorce was granted, the wife may still approach the Family Court regarding permanent alimony and stridhan under relevant provisions.
