
The Kerala High Court observed that many company law matters are essentially family disputes cloaked as corporate battles.
Hearing a 2007 appeal over a will between siblings, Chief Justice Nitin Jamdar remarked, “Most of our company law matters are nothing but family disputes in corporate gloss.”
The Bench, comprising Justice Harisankar V. Menon, recommended mediation, noting that all parties are now elderly and could participate via video conferencing or through representatives.
The Court further added that legal heirs may be more willing to resolve the matter, with younger generations often taking a more pragmatic approach.
