The Madhya Pradesh High Court reduced a man’s conviction from murder under Section 302 IPC to culpable homicide not amounting to murder under Section 304 Part II IPC, observing that the fatal act occurred during a sudden domestic quarrel.
The case involved a man who assaulted his wife with a brick during a heated dispute over a monetary demand, leading to her death.
The bench, noting the absence of premeditation or intent to kill, held that while the accused had knowledge that his act could cause death, he lacked the intention to do so.
Accordingly, the accused’s sentence was reduced to seven years’ imprisonment with a fine of Rs. 5000 under Section 304 II.
