NCLAT Orders Enquiry Into ‘Dubious’ NCLT Chennai Order

National Company Law Appellate Tribunal(NCLAT) raised serious concerns over the National Company Law Tribunal(NCLT)’s handling of the case, terming it “dubious”, and directed an inquiry.

The appeal was filed by Asset Reconstruction Company (India) Limited (ARCIL), challenging an NCLT Chennai order having procedural lapses in 2022.

The order was passed by the NCLAT bench, noting the concerns about the unrecorded hearing date and discrepancies in the NCLT’s order.

Given the above, the NCLAT requested the NCLT President to conduct a thorough inquiry and submit a report to the Chairperson in New Delhi with a copy to the NCLAT for further action.
