NCLAT Lifted the Five-Year Ban imposed by CCI on WhatsApp Data Sharing with Meta Companies

The National Company Law Appellate Tribunal (NCLAT) has stayed the Competition Commission of India's (CCI) five-year ban on WhatsApp sharing user data with Meta Companies for advertising.

However, WhatsApp must comply with CCI directions to provide detailed disclosures on data sharing, specify purposes, and allow users to manage permissions.

The case stems from WhatsApp’s 2021 Privacy Policy, which led to a ₹213.14 crore penalty for anti-competitive practices. NCLAT directed Meta to deposit 50% of the penalty while scheduling further hearings for March 25.

Both parties may seek modifications based on new data protection laws.
