NCLT Dismisses Akshay Kumar's Insolvency Plea U/S 9 of IBC Against Ed Tech Company Cue Learn

The NCLT dismissed Akshay Kumar's petition under Section 9 of the Insolvency and Bankruptcy Code (IBC), holding that his claim of ₹4.05 crore for unpaid endorsement fees does not qualify as operational debt.

Akshay Kumar alleged Cue Learn failed to pay as per a 2021 endorsement agreement.

Cue Learn argued the payment was contingent on Kumar’s availability for a second endorsement day, which was not fulfilled.

The tribunal stated that claims arising from breach of contract fall outside the IBC’s purview and should be adjudicated by civil courts.

Consequently, the plea was dismissed.
