
The National Company Law Tribunal, Mumbai Bench, comprising K.R. Saji Kumar (Member-Judicial) and Anil Raj Chellan (Member-Technical), dismissed an application challenging the maintainability of a Section 7 IBC petition on the ground that documents were scanned via the banned “CamScanner” app.
The corporate debtor contended that such documents were inadmissible secondary evidence. The Bench observed that the annexed documents were notarised and that the summary nature of Section 7 proceedings does not permit detailed document examination or cross-examination.
The Tribunal held that whether the scanning app was banned is irrelevant for maintainability, and rejected the plea to involve the Central Government regarding CamScanner’s usage.
