The Punjab and Haryana High Court dismissed a case against Arun Kumar, who was accused of selling garments under a fake Puma label.
In 2017, Jalandhar Police charged Arun Kumar under Sections 63 and 65 of the Copyright Act for copyright infringement and later added Sections 103 and 104 of the Trade Marks Act for trademark violations.
The Court explained that under Section 13 of the Copyright Act, 1957, copyright does not apply to the manufacture or sale of clothes. It ruled that the prosecution failed to prove infringement under the Copyright Act.
Additionally, charges of trademark infringement were quashed due to non-compliance with procedural requirements under the Trade Marks Act.
