The Allahabad High Court restrained the Bar Associations at Allahabad and Lucknow from charging ₹500 for issuing photo identification of litigants and lawyers.
The Court said this fee, not approved under the Allahabad High Court Rules, was illegal and warned that continuing such charges could lead to contempt.
The court clarified that affidavits sworn before any notary in India must be accepted and cannot be rejected for lacking a photo ID. Highlighting that justice is a constitutional right, the Court called these practices a barrier to access.
The court requested for change to the rule, such as Kerala’s OTP/email method, and will consider the matter further soon.
