
The Supreme Court rejected a plea by a contractual Assistant Public Prosecutor seeking permanent job status.
The Court held he had no legal or constitutional right to regularisation, as his role was temporary. He was initially hired in 2014 by the Purulia District Magistrate and paid per court appearance. His demand for job security, equal pay, and regularisation was dismissed by both the Tribunal and Calcutta High Court.
The Court cited Section 24 of CrPC and now Section 18 of BNSS, which mandate structured merit-based appointments.
The Court found his contractual status legally valid and dismissed his claim while permitting him to petition for enhanced fees separately.
