
The Allahabad High Court denied back wages to an employee who was in jail for nearly three years, ruling that the ‘no work, no pay’ principle applies.
The petitioner was jailed under Section 13(1)(b) of the Prevention of Corruption Act, 1988 for allegedly taking bribes for electricity connections from consumers. After his release, he requested wage payment, but the court rejected it.
In Ranchhodji Chaturji Thakore v. Superintendent Engineer, Gujrat Electricity Board, the Supreme Court held that if an employee is jailed and later acquitted, the employer is not required to pay wages for that period
Accordingly, the writ petition was dismissed.
