Non-National Highway Petrol Pumps can Disallow General Public to Use Toilets: Kerala High Court

The Kerala High Court has held that fuel stations not located on National Highways can refuse to allow the general public to use their toilets.

The court clarified that while customers and transit travellers are entitled to access the facilities, the broader public may be denied entry at the discretion of the station owners or oil marketing companies.

The Court was hearing an appeal filed by Kerala's petroleum dealers association and other individual dealers against the actions of local authorities who were treating toilets at private fuel stations as public conveniences.
