Punjab & Haryana HC Rules NRIs Can Seek Anticipatory Bail but Must Appear in India for Final Hearing

The Punjab and Haryana High Court held that a person living abroad can apply for anticipatory (pre-arrest) bail, but must be physically present in India before the final hearing.

The Court rejected the bail plea of a man living in Canada, accused of dowry harassment and fraud by his wife, and criticized him for ignoring earlier court orders to join the investigation.

The judge said people can't treat India’s legal process casually and just seek bail while sitting in another country.

Such behaviour, the Court added, sets a bad example for others, especially NRIs, and weakens the justice system.
