
The Delhi High Court has held that a single Rolex watch cannot be treated as a “commercial quantity” and may be considered for personal use.
The court was hearing a petition filed by a Dubai resident whose watch was detained by customs officials at the airport.
The bench of Justice Pratibha M. Singh and Justice Shail Jain observed that the Customs Commissioner's order incorrectly implied commercial intent. The court stated that one Rolex watch is not a commercial quantity and that the adjudicating authority must be careful to avoid such errors in future orders.
The court allowed the petitioner to redeem the detained watch by paying a previously imposed redemption fine.
