
The Bombay High Court, delivering a landmark decision, ruled that the human desire for an organ transplant is an integral aspect of the Right to Life under Article 21 of the Constitution.
The ruling came in a plea by Harshad Bhoite, a CKD Stage-V patient, who was denied registration for a kidney transplant as he was not yet on dialysis.
The Court stressed that even patients who urgently need transplants must not be put to procedural hurdles.
The court instructed the authorities to create a special registration facility, ensuring timely access under the Transplantation of Human Organs and Tissues Act, 1994, to protect patient rights.
