Employees Has No vested Right to Choose Place of Posting or Designation : Orissa High Court

The Orissa High Court has ruled that an employee has no vested right to choose their place of posting or designation, reaffirming that such decisions rest solely with the employer based on public interest and administrative exigency.

A Division Bench of Justice Sangam Kumar Sahoo and Justice Savitri Ratho dismissed a petition challenging the Central Administrative Tribunal's decision.

The Court relied on Shilpi Bose v. State of Bihar and State of U.P. v. Gobardhan Lal, emphasizing that posting is an incidence of service.

The writ petition was dismissed, upholding the employer’s discretion in transfers.
