
The Orissa High Court upheld a husband’s divorce plea under Section 13(1)(i-a) of the Hindu Marriage Act, citing mental cruelty after his wife filed 45 FIRs, physically assaulted him and his mother, took over his property, and issued repeated suicide threats.
The Court ruled such actions constitute psychological warfare, making cohabitation impossible.
The husband even resigned from TCS due to harassment. Dismissing the wife's appeal, the Court dissolved the marriage while upholding ₹63 lakh permanent alimony, stating that the law cannot compel a person to endure a marriage of suffering and torment.
