The Orissa High Court dismissed advocate Pranaya Kishore Hari Chandan’s plea challenging the Centre’s decision to restart the selection process for a judicial member post in the GST Appellate Tribunal.
Chandan, who was earlier shortlisted, argued that the process should have continued from the earlier stage.
The Court held that no statutory provision prevents the reconstituted selection committee from conducting a fresh evaluation.
The court also found no illegality in relying on confidential Intelligence Bureau inputs. The bench ruled that, in the absence of legal restrictions, the fresh selection process is valid and lawful.
