Panjab and Haryana High Court Grants Divorce To Man Whose Wife Killed Their Children

The Panjab and Haryana High Court granted divorce to a man whose wife killed their two children in 2010.

The court noted that the wife’s conviction resulted in mental pain and agony for the husband causing a “physical deprivation of matrimonial relationship”. The wife killed their children in 2011 and was sentenced to life imprisonment.

The husband’s divorce plea was first rejected before the Sonipat family court. The high court pointed out that the “conviction is not the ground for divorce but there is mental cruelty and agony so, it is harmful or injurious to live with others”.

Citing the case Swati v. Arvind Mudgil, 2015 the court allowed the dissolution of the marriage.
