Parle Agro Limited filed a trademark infringement suit against PepsiCo in the Delhi High Court, seeking to stop PepsiCo from using the word “Fizz” on its 7UP drink packaging.
Parle Agro claims prior use and statutory rights over "Fizz" through its Appy Fizz brand, introduced in 2005. It alleges PepsiCo’s recent packaging shifts “Fizz” to a prominent position, causing consumer confusion and infringing its trademark.
Senior Advocate Chander Lall argued for urgent relief, while PepsiCo’s counsel, Senior Advocate Dayan Krishnan, denied exclusive rights over “Fizz,” calling it a descriptive term for aerated drinks.
The case is scheduled for hearing on August 18, 2025.
