
In Dabur India's trademark infringement suit, Patanjali Ayurveda defended its Chyavanprash advertisement before the Delhi High Court, claiming it is mere "puffery" and does not disparage Dabur's product.
The Counsel argued that the ad does not refer to Dabur but instead promotes Patanjali's product as the best.
Dabur alleged that the ad misleadingly claims superiority using 51 herbs versus Dabur's 40 herbs, implying that Dabur's product contains mercury, which is unsuitable for children.
Patanjali countered that no competitor was identified in the ad, relying on Delhi HC's Havells India judgment, which allows non-defamatory comparative advertising.
Arguments will continue on 27 January.
