Re-Evaluation Allowed Only in Exceptional Cases, Scrutiny of Answer Sheet Not a Matter of Right

  • Case Name: Bihar Public Service Commission versus Dr. Eena Bahan & Ors
  • Judge(s): C J K. Vinod Chandran and Justice Nani Tagia

The Patna High Court overturned a Single Judge's order to reconsider certain questions, stating such actions are only for exceptional cases with grave errors.

The BPSC had consistently provided answer keys with transparency. The court concluded that no procedural rules were violated that would warrant reconsideration, despite the petitioner's claims of discrepancies.

The high court declared that the code of conduct envisaged in Ran Vijay Singh v State of Uttar Pradesh & Others is not to be applied as a matter of right since it is only provided to address exceptional situations/breaches of the law.

BPSC was instructed to proceed with the selection process.
