Patna High Court Upholds Direction to Withhold DM’s Salary for Non-Compliance

The Patna High Court refused to interfere with a Single Judge’s direction restraining a District Magistrate from drawing salary if compensation ordered to a victim’s family was not paid.

The Division Bench upheld that benefits under a valid government notification cannot be denied merely because its operation is under an interim stay during pending litigation.

The Court emphasised that judicial directions, especially those granting relief, must be complied with in a time-bound manner.

It thus endorsed the use of conditional measures to ensure enforcement of court orders and protect beneficiaries’ rights.
