The Punjab & Haryana High Court ruled the arrest of music producer Pushpinder Pal Singh Dhaliwal illegal as the grounds were conveyed seven hours later, violating Articles 21 & 22 and Section 47 BNSS, 2023.
His daughter filed a habeas corpus plea, stating he was arrested on March 8 without an arrest memo.
The court cited D.K. Basu and Vihaan Kumar cases, stressing that grounds of arrest must be communicated meaningfully and immediately. Noting procedural lapses and the absence of an FIR at detention, the Court ordered Dhaliwal’s release.
The Court also observed that the comment of the Warrant officer on the report on the legality of arrest was "beyond jurisdiction.
