
The Punjab and Haryana High Court struck down Haryana’s policy that enhanced the retirement age from 58 to 60 years only for employees with 70% or more disability.
The Division Bench held that all persons with disabilities issued certificates under The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 and The Rights of Persons with Disabilities Act, 2016 were entitled to the same benefit.
The Court declared the percentage-based classification arbitrary and unconstitutional, ruling that once the State extended a higher age of superannuation to disabled employees, it was required to apply the benefit uniformly without restrictive thresholds.
