
A PIL filed in the Madhya Pradesh High Court seeks a ban on the Jain religious ritual 'Santhara' fasting unto death for minors and persons of unsound mind.
The plea follows the death of a 3-year-old girl in Indore, allegedly forced into Santhara by her family. The petitioner, Pranshu Jain, claims the child lacked understanding or consent, violating fundamental rights under Articles 21 and 39(e) of the Constitution.
The bench has added the parents and the Golden Book of World Records Association as respondents, seeking verification of the certificate naming the child the "youngest to take Santhara".
The plea highlights that Santhara is a voluntary spiritual act, meant only for informed adults. The matter is next listed for hearing on June 23.
