
The Allahabad High Court has observed that while Islam permits polygamy under specific conditions, this provision is often misused, contrary to the true mandate of Muslim law.
The Court noted that the Quran allowed polygamy historically to safeguard widows and orphans after wars, but today, many exploit it for selfish reasons. A Muslim man is entitled to marry multiple times but must ensure equal treatment of all wives; otherwise, multiple marriages are unjustified.
Citing Sarla Mudgal and Lily Thomas, the Court backed the call for a Uniform Civil Code. It clarified that conversion to Islam to contract a second marriage under Muslim law could attract bigamy charges under Section 494 IPC.
