The Supreme Court ruled that laws applicable to undivided Andhra Pradesh continue to apply to Telangana and AP after their 2014 bifurcation.
This decision stemmed from a case where the Andhra Pradesh High Court quashed CBI proceedings against Central Government officials due to a lack of state consent.
The Court, relying on the Andhra Pradesh Reorganisation Act, 2014, held that pre-bifurcation laws remain in effect unless altered or repealed. This is consistent with the precedent set in the Commissioner of Commercial Taxes, Ranchi v. Swarn Rekha Cokes and Coals (P) Ltd., which dealt with the bifurcation of Bihar.
Moreover, it clarified that the CBI does not require state consent to investigate offences committed by Central Government employees under Central Acts.
