
The Delhi High Court issued a notice in a petition filed by Yash Tekwani’s petition to quash an FIR filed by the Directorate of Revenue Intelligence (DRI) for alleged e-cigarette smuggling.
Tekwani, owner of Prince Paan, claimed his August 24, 2024 arrest under Section 108 of the Customs Act was illegal and violated his right against self-incrimination under Article 20(3).
He argued that the E-Cigarettes Act overrides the Customs Act, allowing only authorized officers to act under its provisions. He also said the search and seizure violated Section 103 of the BNSS. The next hearing is scheduled on January 21, 2025.
