The Telangana High Court held that producing an accused before a Magistrate beyond 24 hours of arrest violates Article 22(2) of the Constitution, which mandates timely judicial oversight of detention.
The Court clarified that such illegality cannot be cured by a subsequent remand order, as constitutional safeguards must be strictly followed.
Emphasising protection of personal liberty under Article 21, it ruled that procedural compliance is mandatory and not a mere formality.
Finding a clear violation, the Court granted bail to the accused, noting that the relief was due to procedural lapse and not on merits of the case.
