
The Punjab and Haryana High Court has dismissed a plea seeking action against a runaway couple for allegedly misrepresenting the girl’s age in their protection petition. The Court held that the right to life and personal liberty under Article 21 must take priority.
The court noted that even if forged documents were submitted, protection cannot be denied, and any misrepresentation must be dealt with through a proper investigation under the IPC or POCSO provisions.
The Court also remarked that such pleas often arise from incorrect legal advice and stressed that self-preservation is a fundamental constitutional value.
