Dismissed Police Officers Cannot Claim Pension Benefits : P&H High Court

  • Case Name: Malook Singh v. State of Punjab & Ors.

The Punjab and Haryana High Court ruled that a dismissed police officer is not entitled to pension benefits, regardless of their years of service.

Malook Singh, a former Punjab Police officer who served for 21 years and was dismissed in 1999. His request for a pension was denied, as the court held that granting it would nullify the effect of his dismissal.

Citing Rule 2.5 of the Punjab Civil Services Rules and Rule 16.2 of the Punjab Police Rules, the court stated that dismissed employees are not entitled to a pension, though a compassionate allowance may be allowed in special cases.

The court also noted his delay in filing the petition and upheld the government's decision.
