Raising Voice Against Public Servant Not an Offence Under IPC 353: Karnataka High Court

  • Case Name: Ramesh Karoshi v. State of Karnataka

The Karnataka High Court quashed the criminal case against home guard Ramesh Karoshi who was charged for raising his voice demanding certain documents from a police constable.

Court ruled that raising one's voice does not constitute an offence under Section 353 IPC.

Justice M. Nagaprasanna noted that no criminal force was used against the police constable, complainant.

The Court held that neither Section 353 (assault or criminal force to deter a public servant) nor Section 506 (criminal intimidation) was applicable.

It termed the case an abuse of process of law and dismissed the charges.
