
The Rajasthan High Court dismissed a habeas corpus petition filed by a man claiming his living partner, a married woman who appeared to be his real sister, was illegally detained by her husband.
The Court ruled that no fundamental right exists to live with a married woman legally wed to another, especially when she is his sister.
The Court observed that the alleged live-in relationship has no legal sanctity and held "void ab initio" as per the provisions of Section 23 of the Indian Contract Act.
Citing Navtej Singh Johar v. Union of India (2018) as inapplicable, the Court found the petition untenable under Article 21 and imposed a ₹10,000 cost.
