Rajasthan HC Orders Job for 90% Hearing-Impaired Candidate Wrongly Denied under PwD Quota

  • Case Name: Shri Pankaj Vasita v. State of Rajasthan & Ors.

The Rajasthan High Court ordered the State to give the petitioner, who has 90% hearing impairment, a Safai Karamchari job under the PwD category within 30 days.

A software error excluded the petitioner from the PwD lottery, despite applying under SC and PwD categories in 2018. Although the State admitted the mistake, it failed to correct it.

The Court cited Sections 32 and 33 of the Disabilities Act, 1995, emphasizing the 3% job reservation mandate for people with disabilities, and criticized the state's failure to correct the mistake. 

The Court decided in the petitioner's favor, considering his situation with a Humanitarian approach.
