The Rajasthan High Court directed that live-in relationships agreement must be registered with a government authority or tribunal until formal legislation is enacted.
The court emphasized the need for a legal framework to protect partners and children in such relationships.
It instructed the government to establish a competent authority in each district and create a web portal for registration.
The court proposed a statutory scheme fixing parental responsibilities for children’s welfare and maintenance obligations for non-earning partners.
The court also referred to a larger bench to decide whether married persons in live-in relationships with other individuals without first dissolving their marriage are entitled to seek protection orders from the court.
Authorities must submit a compliance report by March 1, 2025.
