Rajasthan HC Rules SMS/WhatsApp Can Be Used for SC/ST Act Bail Notice, Directs Proof Submission

The Rajasthan High Court ruled that compliance with Section 15A of the SC/ST Act, requiring notice to the complainant before bail hearings, can be fulfilled via SMS or WhatsApp.

The Court directed the DGP and Principal Secretary to ensure investigating officers provide proof, such as screenshots of messages when notifying the complainant.

The decision was made in light of technological advancements and aimed at ensuring timely legal processes.

The Court clarified that while notice is mandatory, the victim's presence at bail hearings is not required.
