Rajasthan High Court Calls Arbitral Tribunal Delay “Appalling” Despite ₹14.5 Crore Fee

The Rajasthan High Court took strong exception to the delay by an arbitral tribunal in deciding a dispute pending since 2019 between three State power companies and HCL Infosystems.

The Court termed the situation “appalling,” noting that despite payment of around ₹14.5 crore as arbitration fees, the matter remains unresolved. It observed that the merits of the dispute have been overshadowed by repeated procedural extensions.

The Court also flagged key concerns regarding the legality of extension orders, tribunal independence, and adherence to statutory timelines, emphasising that time is the essence of arbitration.

It has sought assistance from the Advocate General and decided to examine the issue in detail.
